We operate the websites www.moraviaman.cz and www.moraviaman.eu.
We process your personal data as the data controller, which means we determine how your personal data is processed, for what purpose and for how long, and we may select additional processors to assist us in this processing.

OUR DECLARATION

We declare that as the controller of your personal data, we comply with all legal obligations required by applicable data protection legislation, especially the Data Protection Act and the GDPR. Specifically, this means:

  • We process your personal data only on the basis of valid legal grounds, namely legitimate interest, fulfillment of a contract, legal obligation, or consent;

  • We fulfill our information obligation under Article 13 of the GDPR before beginning the processing;

  • We allow and support you in exercising your rights under the Data Protection Act and the GDPR.


SCOPE OF PERSONAL DATA AND PURPOSES OF PROCESSING

We process personal data that you provide to us for the following reasons (to fulfill these purposes):

Response to contact form inquiries

To get back to you after you fill out the contact form.

Providing services and fulfilling a contract

We need your personal data (billing and contact information) to fulfill a contract (e.g., providing legal services, property sales or rentals, and related services like photography, video production, and promotion).

Collecting basic information from forms

Primarily for initial assessment when responding to property rental offers, etc.

Bookkeeping

If you are our business partner, we need your personal data (billing details) to fulfill our legal obligations for issuing and keeping tax documents.

Marketing – sending newsletters

We use your personal data (email and name), gender, what you click on in emails, and when you typically open them for direct marketing purposes – sending promotional emails.
If you are our customer, we do this based on our legitimate interest, as we reasonably assume you are interested in our updates. We send newsletters for up to 5 years from your last order.
If you are not yet our customer, we will send newsletters only with your consent, also for up to 5 years.
In both cases, you can revoke your consent using the unsubscribe link in every email.

If we come across relevant third-party content in our field, we may recommend it to you via email.

Photos and videos from races and side events

Before, during, and after the event, we may take photos and video recordings. Photos are used for promotional and documentation purposes, mainly on the website. Videos are made publicly available for viewing. We never include participant names with such content unless it’s a testimonial given with consent.
If you do not wish to appear in these materials, please notify us via our contact details before the live event takes place.

Retention period

We retain your personal data for the duration of the applicable limitation periods, unless the law requires a longer retention period or we specify otherwise.

SECURITY AND PROTECTION OF PERSONAL DATA

We protect personal data to the fullest extent possible using modern technologies appropriate to the current level of technical development. We treat your data as if it were our own.
We have adopted and maintain all currently known technical and organizational measures to prevent misuse, damage, or destruction of your personal data.


DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

Your personal data may be accessed by our employees and collaborators, all of whom are bound by confidentiality and have been trained in data protection.

For specific processing tasks that we cannot handle ourselves, we use services and applications of processors who specialize in those areas and are GDPR-compliant. These include:

  • SmartSelling – communication, website, invoicing platform, affiliate system

  • Facebook – Facebook Pixel

  • Google – Google Analytics

  • Instagram

  • Accountant

  • Independent Analytics

  • Česká triatlonová asociace (Czech Triathlon Association)

We may decide to use additional applications or processors in the future to improve data processing. In such cases, we promise to apply at least the same security and quality standards to these providers as we do to ourselves.


DATA TRANSFERS OUTSIDE THE EU

We process your data exclusively within the European Union or in countries that the European Commission has deemed to have an adequate level of data protection.


YOUR RIGHTS UNDER THE GDPR

You have the right to information, which is fulfilled through this privacy notice.

You have the right of access – we will provide confirmation within 30 days of what personal data we process and why.

If your data changes or is incomplete, you have the right to rectification or completion.

You can use the right to restrict processing if you believe your data is inaccurate, if processing is unlawful but you don’t want it erased, or if you’ve objected to the processing.

You can limit the scope of personal data or purposes of processing (e.g., by unsubscribing from newsletters, you limit processing for marketing purposes).

Right to data portability

If you’d like to transfer your data to someone else, we will provide it in a machine-readable format, within 30 days.

Right to erasure (right to be forgotten)

You have the right to have your personal data erased. If you request this, we will delete all of your data from our systems, including from all processors and backups, within 30 days.
Some data must be retained to meet legal obligations (e.g., tax record keeping). In such cases, we will delete all other data not required by law. We will confirm the erasure via email.


COMPLAINT TO THE DATA PROTECTION AUTHORITY

If you believe we are handling your data unlawfully, you have the right to lodge a complaint with the Úřad pro ochranu osobních údajů (Czech Data Protection Authority).
However, we would appreciate if you contacted us first so we can resolve any issues.


UNSUBSCRIBING FROM NEWSLETTERS AND MARKETING EMAILS

If you are a customer, we send you inspirational content, articles, and offers based on our legitimate interest.
If you are not yet a customer, we only send these based on your consent.
In both cases, you can unsubscribe at any time using the link provided in each email.


CONFIDENTIALITY

We assure you that our employees and collaborators who process your personal data are obligated to maintain confidentiality, including any security measures, and that this obligation continues even after the termination of their employment or contractual relationship.
Without your consent, your personal data will not be disclosed to any third party.
